Mediation
Mediation offers a win-win solution for family law disputes, fostering amicable resolutions that benefit all parties involved, especially children.
We are committed to helping our clients resolve disagreements through mediation. Mamata Patel, our trained Mediator, believes that “non-confrontational communication can achieve resolutions that are child-focused and foster good working relationships between parents, family members, and social services.”
Based in Nottingham, our diverse, multi-lingual firm uses best-in-class technology to provide clients with effective family law advice and representation. Our solicitors have a robust reputation for excellence, working with the UK’s best Barristers, King’s Counsel, and other experts to support our Family Law Department as needed.
Our Family Law Ethos
Our Family Solicitors are members of Resolution, an organization promoting non-confrontational approaches to family law disputes. We abide by Resolution’s Code of Practice, working to resolve disputes through negotiation and mediation. If court proceedings become inevitable, we fight tenaciously for the best possible outcomes for you and your children.
Our team includes trained Mediators and members of the Law Society’s Children’s Law Panel, providing comprehensive support when life takes unexpected turns.
Mediation FAQs
What is a MIAM?
A Mediation Information and Assessment Meeting (MIAM) is the first stage in the mediation process. A trained Mediator explains the mediation procedure and its advantages. Mediation is not suitable in cases of bankruptcy, domestic abuse, child protection concerns, previous MIAM attendance, or significant risk of harm. While mediation is not compulsory, attending a MIAM is essential if you wish to bring court proceedings.
What are the Advantages of Mediation?
Mediation offers several benefits:
- Both parties can express their concerns in the presence of a qualified Mediator.
- The Mediator is impartial and assists both parties.
- The process is confidential and costs less than formal court proceedings.
- Mediation is voluntary, and agreements can be made legally binding by the court.
Is What is Agreed During Mediation Legally Enforceable?
While mediation is voluntary, agreements reached can be drafted into legally binding documents by our Solicitors and submitted to the court for approval.
