Discrimination
If you have experienced discrimination at work, you have the right to bring a claim in the Employment Tribunal for compensation.
Employers must not discriminate against you directly or indirectly, but many employees are unsure if their experiences qualify as discrimination. Our Nottingham-based Employment Law Solicitors, recognized by the Legal 500, can swiftly and sensitively advise you on whether you have a valid claim under the Equality Act 2010.
What is Workplace Discrimination?
The Equality Act 2010 outlines nine protected characteristics: age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex, and sexual orientation. It is unlawful for an employer to discriminate against you based on any of these characteristics.
The Act specifies five types of discrimination:
- Direct discrimination
- Indirect discrimination
- Harassment
- Victimisation
- Instructing, causing, inducing, and helping discrimination
Can I Claim for Sexual Harassment?
Sexual harassment is defined as unwanted conduct of a sexual nature that violates your dignity or creates an intimidating, hostile, degrading, humiliating, or offensive environment. Past consensual relationships or the gender of the harasser do not affect the validity of a claim. Our solicitors handle such claims with confidentiality and sensitivity.
What if My Harasser Claims Their Behavior was ‘Banter’?
The Employment Tribunal considers workplace culture in determining whether behavior crosses the line from banter to harassment. For instance, in the case of Smith v Renrod Ltd, the Tribunal ruled that despite a culture of sexual banter, certain comments and conduct were beyond acceptable.
