Fees

Given the diverse nature and complexity of disputes, providing a precise estimate of costs upfront can be challenging. However, we are committed to offering you the best possible cost estimate at the outset and will keep you informed of any changes throughout your case.

The hourly rate charged will depend on the experience and qualifications of your Solicitor. The current rates are as follows:

  • Partner/Member Solicitor: £280
  • Senior Solicitor or Head of Department (PQE 8+ years): £250
  • Assistant Solicitor/Fee Earner (PQE 3-7 years): £215
  • NQ Fee Earner (PQE 1-3 years): £185
  • Paralegals/Trainees: £135
  • Support Paralegals: £115

Please note, these rates are subject to change.

We provide an initial consultation at a fixed fee, pre-agreed to discuss your case and how we can assist you. For straightforward matters, the fee is typically £150 plus VAT for a meeting up to one hour. This fee may increase depending on the complexity of your case, especially if documentation needs to be reviewed before the consultation or if the meeting is expected to exceed one hour.

VAT

All fees are exclusive of VAT, which will be charged at the prevailing rate of 20%.

Indicative Costs for Business-to-Business Debt Action

Below is an estimate of the potential costs for pursuing a business-to-business debt action up to £100,000, divided into three stages.

Stage One – Pre-Action

  • Simple Case: £1,000 to £3,000 (plus VAT and disbursements)
  • Medium Complexity Case: £3,000 to £5,000 (plus VAT and disbursements)
  • High Complexity Case: £5,000+ (plus VAT and disbursements)

These fees typically include:

  • Taking your initial instructions and ongoing consultation.
  • Reviewing documentation and providing advice.
  • Conducting relevant searches.
  • Sending a letter before action.
  • Corresponding with the other party as needed.
  • Handling payments received.

Factors that may increase complexity:

  • A large volume of documentation.
  • Involvement of multiple parties.
  • Dealing with an unrepresented party.
  • Disputed or contested debt.
  • Counterclaims by the other party.

Stage Two – Proceedings

  • Simple Case: £2,000 to £10,000 (plus VAT and disbursements)
  • Medium Complexity Case: £10,000 to £15,000 (plus VAT and disbursements)
  • High Complexity Case: £15,000+ (plus VAT and disbursements)

These fees typically include:

  • Continuation of consultation and document review.
  • Correspondence with relevant parties.
  • Preparation of Claim Form and Particulars of Claim or Defence.
  • Liaising with Counsel as necessary.
  • Applying for Judgment in default if no response is received.
  • Negotiation and settlement efforts.
  • Preparation for and attendance at mediation and hearings.
  • Drafting and reviewing witness statements.
  • Preparing and agreeing on document bundles.

Factors that may increase complexity:

  • Numerous or complex issues.
  • A large number of witnesses.
  • Defended claims.
  • Early settlement.
  • Use of Alternative Dispute Resolution.
  • Unforeseen applications.

Stage Three – Enforcement

  • Simple Case: £1,000 to £3,000 (plus VAT and disbursements)
  • Medium Complexity Case: £3,000 to £5,000 (plus VAT and disbursements)
  • High Complexity Case: £5,000+ (plus VAT and disbursements)

These fees typically include:

  • Advising on enforcement actions and taking instructions.
  • Conducting further searches or inquiries.
  • Making relevant applications.
  • Negotiating repayment proposals.
  • Communicating with involved parties.

Factors that may increase complexity:

  • Numerous or complex issues.
  • Deliberate avoidance of payment by the other party.
  • Extended resolution times.

Disbursements

Disbursements are third-party costs related to your case, such as Counsel’s fees or travel expenses. We manage these payments on your behalf to ensure a smooth process.

  • Counsel’s (Barrister) Fees:

    • High Complexity Case: £15,000+ (plus VAT)
  • Mediation: Fees typically range between £750 and £3,000 (plus VAT).
  • Enforcement Costs:
    • Bailiff Fee (up to £5,000): £77/£100
    • HCEO (over £600): £66
    • Tracing Agent: £100 to £1,000 (plus VAT)
    • Forensic Accountant: £750 to £5,000
    • Transferring the matter to High Court: Fees vary.

Timeline

The duration of your case depends largely on how quickly it is resolved and the stage at which it concludes.

  • Stage One Resolution: Typically within three months.
  • Stage Two Resolution: Up to 12 months, particularly if a final hearing is required. Note that current court backlogs may cause delays.
  • Stage Three Resolution: Typically within three months of commencing enforcement.
